Digital Marketing Services: Including social media management, search engine optimization (SEO), pay-per-click (PPC) advertising, email marketing, and content creation.
Website Design Services: Designing custom websites for nonprofits and social enterprises.
Our services are tailored to meet the unique needs of each client, and we strive to ensure satisfaction and success. However, we do not guarantee any specific outcome, such as receiving grant approvals or specific marketing results.
3. Payment Terms
Payments for our services are outlined as follows:
Grant Writing & Research: Pricing for grant writing services is based on a scaled model and may depend on the grant amount or package selected. A percentage-based fee is applied, with additional fees for research packages and customized services. All fees are agreed upon before work begins.
Digital Marketing & Website Design: Prices for these services may vary based on the scope of the project, and a customized quote will be provided for each client. Once a contract is agreed upon, an initial deposit may be required, with the remaining balance due upon project completion or at milestones defined in the contract.
Failure to pay as agreed may result in suspension or termination of services.
Refund Policy
Refunds are assessed on a case-by-case basis. Grant writing services are non-refundable due to the nature of the work, as time and resources are invested upfront. Refunds for other services may be available, provided that work has not been completed, and such refunds will be subject to a deduction for work completed at the time of cancellation.
4. Client Responsibilities
To provide the best possible service, you agree to:
Provide accurate and complete information required for our services, including but not limited to organizational goals, project details, and timelines.
Respond to our communications promptly to avoid delays in project timelines.
Review all drafts, designs, or proposals thoroughly and provide timely feedback.
Ensure that any content or materials you provide do not infringe on the intellectual property rights of others.
Failure to fulfill these responsibilities may result in delays or additional charges.
5. Intellectual Property Rights
All content, materials, and intellectual property developed during the course of the service remain the property of For Your Social unless otherwise agreed upon. Upon full payment, clients are granted a non-exclusive, perpetual license to use any final deliverables (such as grant proposals, website designs, or marketing materials) for their intended purpose.
Clients are not permitted to resell, redistribute, or otherwise commercially exploit our deliverables without explicit permission.
6. Limitation of Liability
We work hard to ensure the highest quality of service, but we cannot guarantee specific results or outcomes. For Your Social shall not be held liable for:
Failure to secure a grant or specific funding outcome.
Any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use our services or website.
Any losses resulting from third-party actions, including but not limited to data breaches, technical issues, or hosting provider failures.
Our liability is limited to the total fees paid by you for the specific service giving rise to the claim.
7. Service Delivery & Timelines
We strive to deliver all services according to agreed timelines; however, delays may occur due to factors beyond our control (e.g., client response delays, third-party issues). In such cases, we will communicate with you promptly and adjust timelines as necessary.
8. Third-Party Tools and Platforms
Our digital marketing services may require the use of third-party platforms such as Google Ads, social media platforms, or email marketing tools. You agree to the terms and conditions of any third-party services you use through our recommendations or on your behalf.
For Your Social is not responsible for changes in the policies, pricing, or availability of these platforms that may impact your project.
9. Confidentiality
We take the confidentiality of your organization seriously. Any proprietary or sensitive information you share with us in the course of our work will be kept confidential and only used for the purposes of delivering our services.
However, we reserve the right to showcase anonymized versions of completed work in our portfolio unless you request otherwise.
10. Termination of Service
Either party may terminate a service agreement at any time with written notice. Upon termination:
Clients are required to pay for all work completed up until the termination date.
Any incomplete deliverables will remain the intellectual property of For Your Social unless otherwise negotiated.
We reserve the right to terminate services immediately if there is a breach of these terms, including failure to pay for services or misuse of our deliverables.
11. Governing Law
These Terms of Service are governed by the laws of the province of Newfoundland and Labrador, Canada. Any disputes arising from these terms or our services shall be resolved in the courts of Newfoundland and Labrador.
12. Dispute Resolution
In the event of a dispute, we encourage a resolution through good-faith negotiations. If a mutual agreement cannot be reached, either party may pursue legal action in the applicable jurisdiction.
13. Changes to Terms
